There are laws against spamming they have to comply with. Some of those include spamming. They also wouldn't charge you unless, say, you somehow sent enough *upstream* to break their limits, bearing in mind you are sending easily-compressible text files. What I'm trying to say is "this truck is stupid".

There are no laws stating its illegal to spam, unless it interrupts somebody's business (so you can safely spam anyones personal email with no worries.). And your isp is not gonna care about it, I've seen the source code fo sprinkles spammer (I gave it to him, lol), and it uses an existing smtp server (gmail, hotmail, etc.) and your existing email address to do the spamming. The only problem you can run into is having your email account locked for spamming (so use an email address that you don't use for anything else).

Yep I'm sure. As long as its not going to interupt anybody's business or anything like that its fine. Think of it this way, if you were to manually send out like 400 emails to someone, would that be against the law? No way... so using a spammer is doing the exact same thing, just faster.
Also you can spam people's phones with text messages and get away with that too ;)
Well, prepare to be informed:
So long as the mail you send this person is not for commercial gain, e.g. penis extenders, that sort of thing, then it's perfectly legal. However, your ISP can and does monitor your usage and the mail you send in order to comply with this legislation. They might not like you sending lots of spam e-mail and if they've written that into the contract you signed when joining their service they might decide to cut you off, but that's unlikely.
